1Who can play

The Game is intended for players aged 13 and older. If you are under the age of majority where you live, you may only play with the permission of a parent or guardian, and they agree to these terms on your behalf.

2Your licence to play

We give you a personal, non-transferable, non-exclusive licence to install and play the Game on devices you own or control, for your own entertainment. The Game, including its code, artwork, music, characters, names and design, belongs to Fun Maxed Games and is protected by copyright and other laws. We are not selling it to you; you are licensed to play it under these terms.

3Coins, skins and other virtual items

The Game contains a virtual currency ("coins") and virtual items such as ball skins and trails. You can earn them by playing, by watching optional reward videos, or by buying coins with real money.

• Coins and virtual items have no value outside the Game. They cannot be exchanged for real money, goods or services, and cannot be transferred or sold to another player.
• You do not own virtual items. You have a limited licence to use them inside the Game while you play it and while these terms are in force.
• We may change, rebalance, add or remove virtual items and how they are earned or priced. We will try to be fair when we do, but we are not obliged to compensate you for changes.
• Virtual items are tied to the copy of the Game on your device. If you uninstall the Game, reset your progress in the settings, or lose or change your device, your coins and items may be lost. We are not able to restore them.

4Purchases and refunds

Purchases in the Game are processed by Google Play or the Apple App Store, not by us. Their terms, payment methods and refund policies apply to every purchase. We do not receive or store your payment details.

Apart from the rights you have under those store policies or under the law where you live, all purchases are final. Because coins are consumed as you spend them, we cannot refund coins you have already used.

If a purchase does not arrive in the Game, use the Restore Purchases button in the shop or the settings screen first. If that does not fix it, contact us at the address below with your order number and we will help.

5Advertising

The Game shows advertisements, including short full-screen ads between levels, banner ads on some screens, and reward videos that you choose to watch in exchange for coins or other benefits. Ads are provided by Google AdMob and its partners. You can remove the full-screen and banner ads permanently by buying Remove Ads; reward videos you choose to watch remain available. How advertising uses your data is explained in our Privacy Policy.

6Google Play Games and leaderboards

The Game can sign you in to Google Play Games to show achievements and an endless-mode leaderboard. Signing in is optional. Google's own terms and privacy policy apply to your Google account and to the Play Games service. We may remove scores that appear to have been obtained by cheating or tampering.

7Fair play

While using the Game you agree not to:

• cheat, use bots, modified versions of the Game, or tools that alter scores, coins, items or gameplay;
• copy, decompile, reverse engineer or make derivative works of the Game, except where the law allows it;
• sell, rent or share your access to the Game, or resell virtual items;
• interfere with the Game, its services, other players, or the stores it is distributed through;
• use the Game for any unlawful purpose.

If you break these rules we may remove your scores, revoke virtual items, or stop you from playing, without refund.

8Changes and availability

We may update the Game, change or remove features, and release new versions at any time. We may also stop offering the Game altogether. Where we can, we will give notice through the app stores. Online features such as advertising, purchases and leaderboards depend on third-party services and an internet connection, and we cannot promise they will always be available.

9Your progress

Your levels, stars, coins and items are saved on your device. We do not keep a copy on our servers. Please take care when uninstalling the Game, resetting your progress, or moving to a new device.

10No warranty

The Game is provided "as is" and "as available". We work hard to make it fun and reliable, but we do not promise that it will be free of errors or interruptions, that it will work on every device, or that it will meet your expectations. To the fullest extent the law allows, we exclude all warranties that are not stated in these terms.

11Limitation of liability

To the fullest extent the law allows, Fun Maxed Games is not liable for any indirect, incidental or consequential loss, or for loss of data, progress, virtual items or profits, arising from your use of the Game. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us for the Game in the twelve months before the claim, or twenty US dollars, whichever is greater.

Nothing in these terms removes rights that you have as a consumer under the law where you live and that cannot be waived by agreement.

12Ending the agreement

You can end this agreement at any time by uninstalling the Game. We can end it if you break these terms. When it ends, your licence to play and to use virtual items ends with it.

13Changes to these terms

We may update these terms from time to time. The effective date at the top shows when they last changed. If a change is significant we will make it visible in the Game or on the store page. Continuing to play after a change means you accept the new terms.

14Governing law

These terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict-of-law rules, except where the consumer protection law of your own country requires otherwise.
